New Delhi: The Supreme Court on Tuesday dismissed pleas challenging a Calcutta High Court order directing the State Election Commission (SEC) to requisition and deploy central forces across West Bengal for the upcoming panchayat elections. A vacation bench of Justices B V Nagarathna and Manoj Misra, while dismissing the petition, said the fact remains that the tenor of the high court order is ultimately to ensure free and fair elections in the state since it is conducting local body polls on a single day.

The Supreme Court passed this order while responding to a plea challenging the Calcutta High Court’s order regarding the deployment of central forces in panchayat elections.

“No interference is needed in the orders of the high court’s order. Central forces can be deployed in the state. There is no wrong in the high court’s order of deployment of central forces in the panchayat elections,” the top court said.

The bench in its order said, “The fact remains that the tenor of the order of the High Court is ultimately to ensure that a free and fair election is conducted for the entire State of West Bengal since State is conducting the election for local bodies on a single day and having regard to the volume of booths which are being set up. We find that the order of the HC does not call for any interference. SLP stands dismissed.”

The high court had on June 15 directed the SEC to requisition and deploy central forces across West Bengal for the panchayat elections within 48 hours. The court had noted that no appreciable steps had been taken ever since it passed an order on June 13 to deploy central forces in sensitive areas for the poll process.

The high court had directed the SEC to requisition central forces for deployment in all the districts of the state that were rocked by violence during the filing of nominations for the July 8 panchayat elections.

Meanwhile, the ruling Trinamool Congress said that it is their primary responsibility to conduct fair elections and they will be providing adequate forces for that. Multiple incidents of violence and arson have been reported in the state during the nomination process of the panchayat poll and nine people have died so far.

New Delhi: The Supreme Court on Wednesday refused to entertain a plea seeking to prevent a ‘mahapanchayat’ called by Hindu outfits in Uttarakhand and registration of an FIR against hate speeches allegedly targeting members of a particular community.

The ‘mahapanchayat’ is slated to take place on Thursday. A vacation bench of Justices Vikram Nath and Ahsanuddin Amanullah asked advocate Sharukh Alam to avail remedy available in law and granted her liberty to approach the high court or any other authority concerned.

“We are not short-circuiting the legal process. There is a high court and district administration, you can approach them. Maintaining law and order is the responsibility of the state government, why do you think no action will be taken if the matter is brought to its notice? You should have faith in the high court”, the bench said.

Alam stated that posters and letters have been written asking members of a particular community to leave Uttarkashi and despite their being a continuing mandamus in the matter of hate speeches that police have to register an FIR suo motu, no action has been taken.

“The material suggests that FIR needs to be registered under UAPA. A maha panchayat is scheduled to be held on June 15 and they have given an ultimatum to the district administration to remove members of a particular community by June 15”, Alam said and urged the bench to look into the material before the court.

Communal tension has been brewing in Purola and some other towns of Uttarkashi district after two men, one of them Muslim, allegedly tried to abduct a Hindu girl on May 26. Subsequently, posters were pasted by unidentified people on shops owned by Muslims, asking them to leave the town before a ‘mahapanchayat’ called by Hindu organizations in Purola or face consequences.

New Delhi: The Supreme Court on Friday listed to hear on May 15 (Monday) the Securities and Exchange Board of India’s (SEBI) plea seeking to extend the time to conclude the investigation in the report by US short-seller Hindenburg Research by a period of six months. The bench, led by the Chief Justice of India (CJI) DY Chadrachud, and also comprising Justices PS Narsimha and JB Pardiwala, adjourned the matter till May 15.

Meanwhile, the court orally remarked that they will extend the time for the probe to SEBI, but not for six months and they can extend the time for the probe by three months. Solicitor General Tushar Mehta insisted on an extension, citing the involvement of bank statements from multiple domestic and international banks. SEBI application seeking an extension of time has been opposed by the petitioner, Vishal Tiwari.

In an application moved before the Supreme Court, SEBI submitted that keeping in view the forgoing circumstances, it would take further time to arrive at verified findings and conclude the investigation. SEBI, in the application, also submitted that for ascertaining possible violations, it would take at least 15 months for completion of the investigation of these transactions, but is making all reasonable endeavours to conclude the same within six months.

On March 2, the apex court directed the capital market regulator SEBI to investigate any violation of securities law by the Adani Group in the wake of the Hindenburg report, which led to a massive wipeout of more than USD 140 billion of the Adani Group’s market value.

Supreme Court, on March 2, set up an expert committee on the issue arising from the Hindenburg Research report on Adani Group companies. The committee will consist of six members, headed by former apex court judge Justice AM Sapre. The top court had then asked SEBI to file a status report within two months. The apex court was then hearing petitions pertaining to the Hindenburg report, including on the constitution of a committee relating to regulatory mechanisms to protect investors’ interests. There was a loss of investors’ wealth in the securities market after the Hindenburg report because of a steep decline in the share price of the Adani Group (/topic/adani-group) of companies.

The January 24 Hindenburg report alleged stock manipulation and fraud by the conglomerate. The Adani Group (/topic/adani-group) has attacked Hindenburg as “an unethical short seller (/topic/short-seller)”, stating that the report by the New York-based entity was “nothing but a lie”. A short-seller in the securities market books gains from the subsequent reduction in the prices of shares.
